{"id":9434,"date":"2024-05-17T01:00:26","date_gmt":"2024-05-17T00:00:26","guid":{"rendered":"https:\/\/amp.ngo\/?p=9434"},"modified":"2024-05-16T11:19:57","modified_gmt":"2024-05-16T10:19:57","slug":"supreme-court-recognizes-red-tagging-as-a-threat","status":"publish","type":"post","link":"https:\/\/amp.ngo\/en\/supreme-court-recognizes-red-tagging-as-a-threat\/","title":{"rendered":"Supreme Court recognizes \u201cred-tagging\u201d as a threat"},"content":{"rendered":"<p>On May 8, 2024, the Supreme Court (SC) <a href=\"https:\/\/www.hrw.org\/news\/2024\/05\/08\/philippines-supreme-court-rejects-red-tagging\" target=\"_blank\" rel=\"noopener\">issued<\/a> a landmark ruling declaring so-called \u201cred-tagging\u201d (i.e., branding individuals or organizations as \u201cterrorist\u201d) as a \u201cthreat to a person&#8217;s right to life, liberty or security, which may justify the issuance of a writ of amparo.\u201d A writ of amparo allows a person to seek various remedies from the courts, such as protection orders.<\/p>\n<p>According to Human Rights Watch, the SC decision <a href=\"https:\/\/www.hrw.org\/news\/2024\/05\/08\/philippines-supreme-court-rejects-red-tagging\" target=\"_blank\" rel=\"noopener\">confirms<\/a> that \u201c\u2018red-tagging\u2019 is a dangerous form of harassment [and] recognizes the suffering of countless victims of this government policy.\u201d The Philippine Commission on Human Rights (CHR) <a href=\"https:\/\/chr.gov.ph\/statement-of-the-commission-on-human-rights-lauding-the-supreme-court-decision-on-red-tagging-as-a-threat-to-the-right-to-life-liberty-and-security\/\" target=\"_blank\" rel=\"noopener\">emphasized<\/a> in a statement that the definition of \u201cred-tagging\u201d cited in the SC decision \u201creaffirms the subjective and arbitrary nature of the practice.\u201d According to CHR, this also <a href=\"https:\/\/chr.gov.ph\/statement-of-the-commission-on-human-rights-lauding-the-supreme-court-decision-on-red-tagging-as-a-threat-to-the-right-to-life-liberty-and-security\/\" target=\"_blank\" rel=\"noopener\">recognizes<\/a> the \u201creal and immediate\u201d danger of \u201c\u2018red-tagging.\u201d<\/p>\n<p>The SC decision also <a href=\"https:\/\/www.hrw.org\/news\/2024\/05\/08\/philippines-supreme-court-rejects-red-tagging\" target=\"_blank\" rel=\"noopener\">granted<\/a> the petition of activist and former Bayan Muna representative Siegfred Deduro for a writ of amparo. Deduro stated that he felt threatened by the Philippine military because of his <a href=\"https:\/\/www.hrw.org\/news\/2024\/05\/08\/philippines-supreme-court-rejects-red-tagging\" target=\"_blank\" rel=\"noopener\">alleged<\/a> links to the communist armed rebel group New People&#8217;s Army (NPA). The original rejection of his writ of amparo in 2020 by a regional court was overturned by the SC ruling. The SC <a href=\"https:\/\/www.hrw.org\/news\/2024\/05\/08\/philippines-supreme-court-rejects-red-tagging\" target=\"_blank\" rel=\"noopener\">ordered<\/a> the trial court to retry of his case and come up with a verdict within 10 days.<\/p>\n<p>Since April 10, 2024, the labor organizer of the Kilusang Mayo Uno &#8211; Southern Mindanao Region William Lariosa from Bukidnon has been <a href=\"https:\/\/www.bulatlat.com\/2024\/04\/14\/eyewitnesses-say-military-involved-in-abducting-labor-organizer\/\" target=\"_blank\" rel=\"noopener\">missing<\/a>. In a statement, the CHR <a href=\"https:\/\/www.bulatlat.com\/2024\/04\/14\/eyewitnesses-say-military-involved-in-abducting-labor-organizer\/\" target=\"_blank\" rel=\"noopener\">condemned<\/a> Lariosa&#8217;s abduction and launched a quick response operation. According to eyewitness reports, the Philippine military is <a href=\"https:\/\/www.bulatlat.com\/2024\/04\/14\/eyewitnesses-say-military-involved-in-abducting-labor-organizer\/\" target=\"_blank\" rel=\"noopener\">believed<\/a> to be linked to his disappearance.<\/p>\n<p>The Makabayan group in the House of Representatives <a href=\"https:\/\/www.philstar.com\/headlines\/2024\/05\/03\/2352336\/makabayan-bloc-slams-terror-law-charges-vs-34-activists\" target=\"_blank\" rel=\"noopener\">condemned<\/a> on May 3, 2024, the allegations of the Philippine military against Bayan-Muna Secretary General Nathanael Santiago and 33 other activists in the province of Nueva Ecija for alleged involvement in a encountering of government security forces and an alleged terrorist group in Nueva Ecija 2023.
