{"id":9033,"date":"2024-02-14T01:00:02","date_gmt":"2024-02-14T00:00:02","guid":{"rendered":"https:\/\/amp.ngo\/?p=9033"},"modified":"2024-02-13T15:00:41","modified_gmt":"2024-02-13T14:00:41","slug":"new-procedural-rules-on-the-anti-terrorism-act","status":"publish","type":"post","link":"https:\/\/amp.ngo\/en\/new-procedural-rules-on-the-anti-terrorism-act\/","title":{"rendered":"New procedural rules on the Anti-Terrorism Act"},"content":{"rendered":"<p>On January 1, 2024, the Supreme Court (SC) issued a set of procedural <a href=\"https:\/\/sc.judiciary.gov.ph\/sc-issues-rules-on-anti-terrorism-cases\/\" target=\"_blank\" rel=\"noopener\">rules<\/a> governing all petitions and applications in relation with the problematic Anti-Terrorism Act (ATA) of 2020; the rules came into force on January 15.<\/p>\n<p>The new &#8220;Rules on the ATA of 2020 and Related Laws&#8221; <a href=\"https:\/\/www.rappler.com\/newsbreak\/explainers\/content-supreme-court-new-rules-anti-terror-law\/\" target=\"_blank\" rel=\"noopener\">stipulate<\/a>, among other things, that after a person has been designated as a suspected &#8220;terrorist,&#8221; they can file a petition for &#8220;certiorari&#8221; (i.e., to review grave abuse of discretion) with the SC to challenge the allegation. Nevertheless, the broad definition of &#8220;terrorism&#8221; under Section 4 of the Act remained <a href=\"https:\/\/www.rappler.com\/newsbreak\/explainers\/anti-terror-law-irr-delisting-added-condition-warrantless-arrest-no-house-arrest-bailable-crimes\/\" target=\"_blank\" rel=\"noopener\">unchanged<\/a>.<\/p>\n<p>The National Union of Peoples&#8217; Lawyers (NUPL) <a href=\"https:\/\/newsinfo.inquirer.net\/1884587\/nupl-on-anti-terror-act-rules\" target=\"_blank\" rel=\"noopener\">endorsed<\/a> the new rules on the ATA, but also emphasized that they &#8220;cannot address, much less cure, the fundamental flaws of the law which [they] continue to assail as perilous to civil liberties.&#8221;<\/p>\n<p>Kristina Conti, Secretary General of the NUPL, further <a href=\"https:\/\/www.rappler.com\/newsbreak\/explainers\/content-supreme-court-new-rules-anti-terror-law\/\" target=\"_blank\" rel=\"noopener\">explained<\/a> that the procedural rules issued by the Department of Justice (DOJ) \u201conly elaborated on delisting, based on mistaken identity, change of circumstances, and the like\u201d when a petition for &#8220;certiorari&#8221; is filed within a 20-day period. She <a href=\"https:\/\/www.rappler.com\/newsbreak\/explainers\/content-supreme-court-new-rules-anti-terror-law\/\" target=\"_blank\" rel=\"noopener\">emphasized<\/a> that such remedies are options that can be used after something has already happened. According to <a href=\"https:\/\/www.rappler.com\/newsbreak\/explainers\/content-supreme-court-new-rules-anti-terror-law\/\" target=\"_blank\" rel=\"noopener\">Conti<\/a>, protective measures to prevent abuses from occurring in the first place are still lacking.<\/p>\n<p>The NUPL also criticized the fact that the procedural rules would not automatically lift the orders for the <a href=\"https:\/\/newsinfo.inquirer.net\/1884587\/nupl-on-anti-terror-act-rules\" target=\"_blank\" rel=\"noopener\">preventive<\/a> freezing of funds of persons or groups suspected of financing terrorism after 20 days. In the past, activists have repeatedly been <a href=\"https:\/\/amp.ngo\/en\/activists-targeted-by-government-for-money-laundering\/\">targeted<\/a> by the government for suspected money laundering.<\/p>\n<p>In this context, six UN Special Rapporteurs also published <a href=\"https:\/\/globalnation.inquirer.net\/225279\/6-un-experts-flag-unchecked-antiterror-powers-in-letter-to-marcos\" target=\"_blank\" rel=\"noopener\">recommendations<\/a> to the Philippine government in a 19-page letter on October 10, 2023. In the letter, they asked the government to <a href=\"https:\/\/globalnation.inquirer.net\/225279\/6-un-experts-flag-unchecked-antiterror-powers-in-letter-to-marcos\" target=\"_blank\" rel=\"noopener\">explain<\/a>, among others, cases of &#8220;judicial harassment, office raids and targeted financial sanctions&#8221; against human rights defenders. In addition, they called on the government to curb the &#8220;seemingly broad and unchecked executive powers&#8221; of the Anti-Terrorism Council (ATC) and the Anti-Money Laundering Council (AMLC) in the prosecution of human rights defenders.
