{"id":8881,"date":"2023-12-01T01:00:40","date_gmt":"2023-12-01T00:00:40","guid":{"rendered":"https:\/\/amp.ngo\/?p=8881"},"modified":"2023-11-30T20:14:40","modified_gmt":"2023-11-30T19:14:40","slug":"former-senator-leila-de-lima-is-free-on-bail","status":"publish","type":"post","link":"https:\/\/amp.ngo\/en\/former-senator-leila-de-lima-is-free-on-bail\/","title":{"rendered":"Leila De Lima free on bail, Marcos considers rejoining ICC"},"content":{"rendered":"<p>Former senator and opposition politician Leila de Lima was <a href=\"https:\/\/www.rappler.com\/philippines\/leila-de-lima-statement-muntinlupa-court-grants-bail-november-13-2023\/\" target=\"_blank\" rel=\"noopener\">released<\/a> on bail in the amount of PHP 300,000 on November 13, 2023, after more than six years in prison. De Lima thanked President Ferdinand Marcos Jr. for upholding the independence of the court and the rule of law. However, the acquittal in her case is still pending. De Lima had fought against her politically motivated imprisonment for many <a href=\"https:\/\/amp.ngo\/en\/eu-parliament-calls-for-de-limas-release\/\">years<\/a> with great resilience.<\/p>\n<p>De Lima was imprisoned in February 2017 for alleged involvement in drug trafficking. The charges <a href=\"https:\/\/amp.ngo\/en\/project\/amp-2022-report-human-rights-in-the-philippines\/\">came<\/a> after she, as former Secretary of Justice, initiated an investigation into the extrajudicial killings of alleged drug users by the so-called &#8220;Davao Death Squad&#8221; of ex-president and then mayor of Davao City, Rodrigo Duterte, in 2012. In 2016, 16 senators <a href=\"https:\/\/verafiles.org\/articles\/the-day-when-senators-blood-ran-cold\" target=\"_blank\" rel=\"noopener\">voted<\/a> to remove De Lima from her chairmanship of the Senate Committee on Justice and Human Rights in order to stop her political power to act against Duterte.<\/p>\n<p>Numerous support groups of De Lima celebrated her long &#8220;<a href=\"https:\/\/newsinfo.inquirer.net\/1859101\/various-groups-celebrate-as-court-allows-leila-de-lima-to-post-bail\" target=\"_blank\" rel=\"noopener\">overdue<\/a>&#8221; grant of bail. Her case is also seen as an important<a href=\"https:\/\/www.rappler.com\/philippines\/statements-lawmakers-court-grants-bail-de-lima-november-2023\/\" target=\"_blank\" rel=\"noopener\"> inspiration<\/a> in the fight to free all political prisoners in the Philippines. A US senator also <a href=\"https:\/\/globalnation.inquirer.net\/222763\/us-lawmaker-calls-for-dropping-of-last-drug-case-against-leila-de-lima\" target=\"_blank\" rel=\"noopener\">urged<\/a> the Philippine government to <a href=\"https:\/\/amp.ngo\/en\/political-prisoner-leila-de-limas-request-for-bail-denied\/\">drop<\/a> the last existing case against de Lima. Most of the incriminating statements against De Lima have already been withdrawn. A few days after her release, seven individuals from the Bilibid prison also <a href=\"https:\/\/newsinfo.inquirer.net\/1863578\/7-more-inmates-recant-testimonies-vs-leila-de-lima\" target=\"_blank\" rel=\"noopener\">withdrew<\/a> their testimonies against De Lima on November 17, 2023. The Canadian and US embassies and the European Union delegation, among others, also <a href=\"https:\/\/www.manilatimes.net\/2023\/11\/13\/news\/eu-canada-uk-us-welcome-de-limas-release\/1919627\" target=\"_blank\" rel=\"noopener\">welcomed<\/a> de Lima&#8217;s temporary release.<\/p>\n<p>Human Rights Watch <a href=\"https:\/\/newsinfo.inquirer.net\/1859101\/various-groups-celebrate-as-court-allows-leila-de-lima-to-post-bail\" target=\"_blank\" rel=\"noopener\">believes<\/a> that De Lima should not have been arrested in the first place, as she was merely carrying out her work. FORUM-ASIA Director Mary Aileen Diez-Bacalso <a href=\"https:\/\/gutzy.asia\/2023\/11\/16\/forum-asia-hails-leila-de-limas-release-demands-justice-and-accountability\/\" target=\"_blank\" rel=\"noopener\">demands<\/a> that those responsible for the fabricated charges and false imprisonment should be held accountable. De Lima is already <a href=\"https:\/\/www.gmanetwork.com\/news\/topstories\/nation\/888234\/no-regrets-leila-de-lima-seeks-vindication-filing-counter-charges-an-option\/story\/\" target=\"_blank\" rel=\"noopener\">considering<\/a> this through legal means.<\/p>\n<p>According to Dino de Leon, a lawyer in De Lima&#8217;s legal team, there is also the <a href=\"https:\/\/newsinfo.inquirer.net\/1859943\/leila-de-limas-lawyers-say-shes-interested-in-helping-icc\" target=\"_blank\" rel=\"noopener\">possibility<\/a> that de Lima will continue to cooperate with the International Criminal Court&#8217;s (ICC) investigation into alleged crimes against humanity in the so-called &#8220;war on drugs&#8221; under Rodrigo Duterte during his time as mayor of Davao City and president of the Philippines (2011-2019). The Philippine government <a href=\"https:\/\/manilastandard.net\/news\/314383825\/marcos-stand-on-international-probe-on-ph-drug-war-unchanged.html?utm_source=substack&amp;utm_medium=email#:~:text=President%20Ferdinand%20Marcos%20Jr.&#039;s,Solicitor%20General%20Menardo%20Guevarra%20said.\" target=\"_blank\" rel=\"noopener\">refuses<\/a> to <a href=\"https:\/\/amp.ngo\/en\/philippines-challenges-icc-investigation-again\/\">cooperate<\/a> with the ICC. However, on October 24, 2023, President Marcos <a href=\"https:\/\/www.bworldonline.com\/the-nation\/2023\/11\/26\/559779\/analysts-govt-shifting-stance-on-icc-probe-may-end-up-giving-up-duterte\/\" target=\"_blank\" rel=\"noopener\">announced<\/a> that his government was considering rejoining the ICC. It is not clear whether the Marcos government also supports the ICC investigation.<\/p>\n<p>Philippine Justice Secretary Jesus Crispin Remulla initially <a href=\"https:\/\/businessmirror.com.ph\/2023\/11\/15\/remulla-de-limas-release-bolsters-phl-govts-position-against-icc-intervention\/?utm_source=rss&amp;utm_medium=rss&amp;utm_campaign=remulla-de-limas-release-bolsters-phl-govts-position-against-icc-intervention\" target=\"_blank\" rel=\"noopener\">stated<\/a> that the temporary release of de Lima was proof that the Philippines&#8217; legal system was intact. Remulla has now also <a href=\"https:\/\/www.rappler.com\/newsbreak\/in-depth\/leila-de-lima-release-house-push-international-criminal-court-drug-war-probe\/\" target=\"_blank\" rel=\"noopener\">distanced<\/a> himself somewhat from his previously hard-line position against the ICC investigation and <a href=\"https:\/\/www.rappler.com\/philippines\/remulla-now-says-icc-cooperation-needs-serious-study\/\" target=\"_blank\" rel=\"noopener\">said<\/a> that the recommendations to resume co-operation with the ICC require &#8220;serious study.&#8221;<\/p>\n<p>This came after Remulla <a href=\"https:\/\/businessmirror.com.ph\/2023\/10\/26\/doj-to-study-makabayan-blocs-call-to-allow-icc-to-investigate-ex-president-dutertes-war-on-drugs\/\" target=\"_blank\" rel=\"noopener\">called<\/a> for an investigation of the statements made by the Makabayan bloc and other lawmakers in the House of Representatives. The lawmakers <a href=\"https:\/\/www.rappler.com\/newsbreak\/in-depth\/leila-de-lima-release-house-push-international-criminal-court-drug-war-probe\/\" target=\"_blank\" rel=\"noopener\">filed<\/a> a resolution in the House of Representatives on October 17, 2023, calling on the government under President Marcos Jr. to <a href=\"https:\/\/www.manilastandard.net\/news\/314390994\/makabayan-asks-pbbm-to-support-icc-investigation-of-rodys-drug-war.html\" target=\"_blank\" rel=\"noopener\">reopen<\/a> the ICC investigation.
