{"id":8869,"date":"2023-12-01T01:00:04","date_gmt":"2023-12-01T00:00:04","guid":{"rendered":"https:\/\/amp.ngo\/?p=8869"},"modified":"2023-11-30T18:12:05","modified_gmt":"2023-11-30T17:12:05","slug":"death-threat-against-lawmaker-rodrigo-duterte-receives-subpoena","status":"publish","type":"post","link":"https:\/\/amp.ngo\/en\/death-threat-against-lawmaker-rodrigo-duterte-receives-subpoena\/","title":{"rendered":"Death threat: Rodrigo Duterte receives subpoena"},"content":{"rendered":"<p>On October 24, 2023, France Castro, a member of the Philippine House of Representatives from the Alliance of Concerned Teachers (ACT) party-list group, filed a criminal <a href=\"https:\/\/www.rappler.com\/philippines\/rodrigo-duterte-faces-criminal-complaint-france-castro-october-2023\/\" target=\"_blank\" rel=\"noopener\">complaint<\/a> against former President Rodrigo Duterte <a href=\"https:\/\/newsinfo.inquirer.net\/1850793\/parang-ako-pa-may-kasalanan-castro-slams-criticisms-on-her-case-vs-duterte\" target=\"_blank\" rel=\"noopener\">for<\/a> serious threats to her life. This was due to <a href=\"https:\/\/www.rappler.com\/philippines\/act-teachers-representative-france-castro-file-criminal-complaint-rodrigo-duterte-october-2023\/\" target=\"_blank\" rel=\"noopener\">death threats<\/a> against Castro, which Duterte <a href=\"https:\/\/www.bworldonline.com\/the-nation\/2023\/11\/16\/558139\/duterte-laughed-off-doj-summons-says-spokesman\/\" target=\"_blank\" rel=\"noopener\">made<\/a> in an <a href=\"https:\/\/www.macaubusiness.com\/philippine-prosecutor-summons-duterte-over-death-threat\/\" target=\"_blank\" rel=\"noopener\">interview<\/a> on October 10 on the controversial Sonshine Media Network International (SMNI) channel. Duterte <a href=\"https:\/\/www.bworldonline.com\/the-nation\/2023\/11\/16\/558139\/duterte-laughed-off-doj-summons-says-spokesman\/\" target=\"_blank\" rel=\"noopener\">called<\/a> Castro a &#8220;communist&#8221; who should be killed using the confidential funds requested by his daughter and current vice president, Sara Duterte-Carpio, for the Department of Education to fight the communist insurgency in the Philippines.<\/p>\n<p>In his statements, Duterte <a href=\"https:\/\/www.rappler.com\/nation\/house-denies-confidential-fund-request-ovp-deped-da-dict-dfa-2024\/\" target=\"_blank\" rel=\"noopener\">appeared<\/a> to be referring to the House of Representatives&#8217; decision on October 10, 2023, rejecting the proposals for confidential funds for the next budget of five government agencies &#8211; including the <a href=\"https:\/\/amp.ngo\/en\/vice-president-duterte-debate-over-confidential-funds\/\">contested<\/a> request of the Department of Education, which is headed by Sara Duterte-Carpio. Castro also believes that she came under fire from Duterte because she had previously <a href=\"https:\/\/time.com\/6335372\/rodrigo-duterte-philippines-subpoena-court-summons\/\" target=\"_blank\" rel=\"noopener\">questioned<\/a> the <a href=\"https:\/\/www.bworldonline.com\/the-nation\/2023\/11\/16\/558139\/duterte-laughed-off-doj-summons-says-spokesman\/\" target=\"_blank\" rel=\"noopener\">use<\/a> of the confidential funds requested by the Department of Education.<\/p>\n<p>Rodrigo Duterte <a href=\"https:\/\/time.com\/6335372\/rodrigo-duterte-philippines-subpoena-court-summons\/\" target=\"_blank\" rel=\"noopener\">first<\/a> received a written subpoena to the office of the public prosecutor in Quezon City on December 4 and 11, 2023 to comment on the allegations and submit the necessary documents. He <a href=\"https:\/\/www.bworldonline.com\/the-nation\/2023\/11\/16\/558139\/duterte-laughed-off-doj-summons-says-spokesman\/\" target=\"_blank\" rel=\"noopener\">laughed<\/a> about the criminal complaint and Castro&#8217;s legal steps.<\/p>\n<p>When Rodrigo Duterte\u2019s presidential term ended with the change of government in June 2022, he also lost his <a href=\"https:\/\/www.rappler.com\/philippines\/rodrigo-duterte-faces-criminal-complaint-france-castro-october-2023\/\" target=\"_blank\" rel=\"noopener\">immunity<\/a>. Castro&#8217;s criminal complaint is therefore the first <a href=\"https:\/\/www.rappler.com\/philippines\/rodrigo-duterte-faces-criminal-complaint-france-castro-october-2023\/\" target=\"_blank\" rel=\"noopener\">attempt<\/a> to hold Duterte accountable for unlawful statements or actions by means of Philippine jurisdiction.<\/p>\n<p>Castro rejected <a href=\"https:\/\/newsinfo.inquirer.net\/1850793\/parang-ako-pa-may-kasalanan-castro-slams-criticisms-on-her-case-vs-duterte\" target=\"_blank\" rel=\"noopener\">accusations<\/a> by Rodrigo Duterte&#8217;s son Paolo Duterte about their legal action. The latter <a href=\"https:\/\/newsinfo.inquirer.net\/1850793\/parang-ako-pa-may-kasalanan-castro-slams-criticisms-on-her-case-vs-duterte\" target=\"_blank\" rel=\"noopener\">said<\/a> that the law should not be used to silence critics and that his father himself had not filed any complaints regarding his freedom of expression. In her complaint, Castro also referred to the <a href=\"https:\/\/www.rappler.com\/philippines\/rodrigo-duterte-faces-criminal-complaint-france-castro-october-2023\/\" target=\"_blank\" rel=\"noopener\">structural<\/a> violence of unfounded &#8220;red-tagging&#8221;, i.e. the false accusation of supporting the communist insurgency in the Philippines.
