{"id":8515,"date":"2023-06-26T01:00:54","date_gmt":"2023-06-26T00:00:54","guid":{"rendered":"https:\/\/amp.ngo\/?p=8515"},"modified":"2024-02-02T11:39:30","modified_gmt":"2024-02-02T10:39:30","slug":"philippines-challenges-icc-investigation-again","status":"publish","type":"post","link":"https:\/\/amp.ngo\/en\/philippines-challenges-icc-investigation-again\/","title":{"rendered":"Philippines challenges ICC investigation again"},"content":{"rendered":"<p>On May 19, 2023, the Philippine government made a fresh attempt to <a href=\"https:\/\/newsinfo.inquirer.net\/1772330\/ph-contests-anew-obligation-to-cooperate-with-icc\" target=\"_blank\" rel=\"noopener\">challenge<\/a> its commitment to cooperate with the International Criminal Court (ICC) regarding its investigation into alleged crimes against humanity in the so-called &#8220;<a href=\"https:\/\/www.hrw.org\/the-day-in-human-rights\/2023\/06\/09\" target=\"_blank\" rel=\"noopener\">war on drugs<\/a>&#8221; under R. Duterte, during his time as President of the Philippines and Mayor of Davao City (2011-2019). In its response to the ICC regarding the current appeal, the Philippine government <a href=\"https:\/\/www.philstar.com\/headlines\/2023\/05\/21\/2267825\/philippines-not-required-cooperate-icc-probe-solgen\" target=\"_blank\" rel=\"noopener\">argues<\/a> that former ICC Prosecutor Fatou Bensouda&#8217;s initial preliminary investigation in 2018 &#8211; which was launched before the Philippines&#8217; withdrawal in March 2019 &#8211; already constituted an examination of alleged human rights violations in the &#8220;war on drugs.&#8221;<\/p>\n<p>In January 2023, the ICC Pre-Trial Chamber allowed the <a href=\"https:\/\/www.cnnphilippines.com\/news\/2023\/1\/27\/ICC-authorizes-prosecutor-to-resume-probe-into-PH-drug-war.html\" target=\"_blank\" rel=\"noopener\">reopening<\/a> of the investigation in the Philippines, which had been <a href=\"https:\/\/edition.cnn.com\/2021\/11\/20\/asia\/icc-suspended-philippines-war-intl-hnk\/index.html\" target=\"_blank\" rel=\"noopener\">stalled<\/a> since November 2021. The government <a href=\"https:\/\/amp.ngo\/en\/marcos-government-rejects-icc-investigation-extrajudicial-killings-continue\/\">failed<\/a> to demonstrate sufficient national investigation into the cases of extrajudicial killings in the &#8220;war on drugs.&#8221; The Philippine government appealed, arguing in particular that this would violate its <a href=\"https:\/\/www.cnnphilippines.com\/news\/2023\/5\/13\/ICC-allows-PH-reply-drug-war-probe.html\" target=\"_blank\" rel=\"noopener\">sovereignty<\/a>. On April 4, 2023, Prosecutor Karim Khan submitted a 56-page response asking the ICC to <a href=\"https:\/\/www.cnnphilippines.com\/news\/2023\/4\/12\/ICC-prosecutor-rejects-Philippine-government-arguments-drug-war.html\" target=\"_blank\" rel=\"noopener\">reject<\/a> the country&#8217;s petition.<\/p>\n<p><a href=\"https:\/\/www.philstar.com\/headlines\/2023\/05\/24\/2268601\/drug-war-victims-families-submit-documents-icc\" target=\"_blank\" rel=\"noopener\">Survivors and victims<\/a> of the &#8220;war on drugs&#8221; are calling for the continuation of the investigations, as they continue to consider their prospects of receiving justice under the current Marcos government as <a href=\"https:\/\/www.cnnphilippines.com\/news\/2023\/1\/27\/ICC-authorizes-prosecutor-to-resume-probe-into-PH-drug-war.html\" target=\"_blank\" rel=\"noopener\">not amounting<\/a> to &#8220;tangible, concrete and progressive investigative steps in a way that would sufficiently mirror the Court\u2019s investigation.\u201d This was reiterated by 350 affected individuals and 165 families in a 21-page <a href=\"https:\/\/www.icc-cpi.int\/sites\/default\/files\/RelatedRecords\/0902ebd18048e51d.pdf\" target=\"_blank\" rel=\"noopener\">report<\/a> they submitted through the Victims Participation and Reparations Section (VPRS) of the ICC on May 22, 2023, to promote the conduct of the investigation from a <a href=\"https:\/\/www.icc-cpi.int\/sites\/default\/files\/itemsDocuments\/vprs\/VPRS-Victims-booklet-format-ENG.pdf#page=13\" target=\"_blank\" rel=\"noopener\">victim-oriented perspective<\/a>. The report <a href=\"https:\/\/www.rappler.com\/newsbreak\/in-depth\/icc-next-move-philippines-appeals-chamber-hope-reality-check\/?utm_source=substack&amp;utm_medium=email\" target=\"_blank\" rel=\"noopener\">highlighted<\/a> in particular the existing <a href=\"https:\/\/newsinfo.inquirer.net\/1774474\/anti-drug-war-victims-seek-resumption-of-icc-probe-on-extra-judicial-killings?utm_source=substack&amp;utm_medium=email\" target=\"_blank\" rel=\"noopener\">lack<\/a> of documentation of cases of extrajudicial killings and state interventions or investigations.<\/p>\n<p>In the next two to three months, the ICC Appeals Chamber will take a decision on whether Khan can <a href=\"https:\/\/www.rappler.com\/newsbreak\/in-depth\/icc-next-move-philippines-appeals-chamber-hope-reality-check\/?utm_source=substack&amp;utm_medium=email\" target=\"_blank\" rel=\"noopener\">continue<\/a> his investigation in the Philippines. If this were to happen, however, the ICC chief prosecutor would continue to face the difficulty of the lack of, or support for, police power in the Philippines.<\/p>\n<p>The EU also welcomed the Philippines&#8217; pro-EU position on the Ukraine-Russia war during the annual EU-ASEAN Business Council dinner in Manila in late May 2023 and reiterated its support regarding the Philippines&#8217; sovereignty claims in the conflict within the <a href=\"https:\/\/news.abs-cbn.com\/news\/05\/26\/23\/eu-raises-need-to-respect-international-law-in-west-ph-sea\" target=\"_blank\" rel=\"noopener\">West Philippine Sea<\/a>. President Marcos Jr. also called there for the <a href=\"https:\/\/newsinfo.inquirer.net\/1774791\/bongbong-marcos-calls-for-the-resumption-of-negotiations-for-bilateral-ph-eu-trade-agreement\" target=\"_blank\" rel=\"noopener\">resumption<\/a> of talks on the EU-Philippines Free Trade Agreement. Trade Secretary Alfredo Pascual <a href=\"https:\/\/www.gmanetwork.com\/news\/money\/economy\/872158\/dti-chief-pascual-talks-about-free-trade-deal-with-eu-should-start\/story\/\" target=\"_blank\" rel=\"noopener\">expressed<\/a> to address this as well as the status of the Philippines&#8217; reapplication for the Generalised Scheme of Preferences (GSP+) Scheme during his June 2023 visit to Brussels.<\/p>\n<p>The GSP+ has so far <a href=\"https:\/\/amp.ngo\/en\/eu-parliamentarians-discussed-human-rights-situation-with-philippine-government-in-manila\/\">allowed<\/a> the Philippines trade preferences on over 6,000 export products to the EU as long as, among others, international human rights standards are respected.
