{"id":8311,"date":"2023-04-28T01:00:25","date_gmt":"2023-04-28T00:00:25","guid":{"rendered":"https:\/\/amp.ngo\/?p=8311"},"modified":"2023-04-27T15:16:43","modified_gmt":"2023-04-27T14:16:43","slug":"ntf-elcac-criticises-human-rights-defenders-protection-bill","status":"publish","type":"post","link":"https:\/\/amp.ngo\/en\/ntf-elcac-criticises-human-rights-defenders-protection-bill\/","title":{"rendered":"NTF-ELCAC criticises Human Rights Defenders Protection Bill"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">The Human Rights Committee approved the Human Rights Defender Bill (or House Bill 77\/HB77) in February 2023, which is currently under <\/span><a href=\"https:\/\/www.philstar.com\/nation\/2023\/03\/17\/2252270\/chr-calls-dialogue-hr-defenders-bill\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">consideration<\/span><\/a><span style=\"font-weight: 400;\"> in the plenary. The Commission on Human Rights (CHR) emphasized that protecting human rights defenders (HRD) is a &#8220;legal and moral <\/span><a href=\"https:\/\/chr.gov.ph\/statement-of-the-commission-on-human-rights-on-the-opposition-against-the-bill-protecting-human-rights-defenders\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">obligation<\/span><\/a><span style=\"font-weight: 400;\">\u201d of the state to preserve democracy.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In a press conference from March 13, 2023, the National Task Force to End Local Communist Armed Conflict (NTF-ELCAC) <\/span><a href=\"https:\/\/www.philstar.com\/nation\/2023\/03\/17\/2252270\/chr-calls-dialogue-hr-defenders-bill\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">claimed<\/span><\/a><span style=\"font-weight: 400;\"> that the term &#8220;human rights defender,&#8221; which is used in the bill, is too broad and puts this group of people on the same level with enemies of the state, such as terrorists and rebels. The Philippine Alliance of Human Rights Advocates (PAHRA) and the Task Force Detainees of the Philippines (TDFP) who were directly accused by the NTF-ELCAC <\/span><a href=\"https:\/\/www.philstar.com\/headlines\/2023\/03\/15\/2251887\/groups-score-ntf-elcac-equating-human-rights-work-terrorism\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">defended<\/span><\/a><span style=\"font-weight: 400;\"> themselves in separate statements. They said the NTF-ELCAC&#8217;s statement lumps HRDs together with terrorists and criminals. With these accusations, NTF-ELCAC is putting HRDs in serious danger and would therefore even <\/span><a href=\"https:\/\/www.philstar.com\/headlines\/2023\/03\/15\/2251887\/groups-score-ntf-elcac-equating-human-rights-work-terrorism\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">label<\/span><\/a><span style=\"font-weight: 400;\"> the United Nations &#8211; which created the framework for this bill &#8211; as communist sympathisers.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Secretary General of the human rights group Karapatan, Cristina Palabay, <\/span><a href=\"https:\/\/www.altermidya.net\/chr-reiterates-support-for-rights-defender-bill-urges-stop-of-fear-mongering\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">stated<\/span><\/a><span style=\"font-weight: 400;\"> that the NTF-ELCAC opposes the bill as it would directly challenge NTF-ELCAC&#8217;s central role in so-called &#8220;red-tagging&#8221; (i.e. accusation of supporting the communist insurgency) and increased attacks against HRDs.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The United Nations Special Rapporteur on HRD, Mary Lawlor, <\/span><a href=\"https:\/\/news.abs-cbn.com\/news\/03\/25\/23\/un-expert-urges-law-protecting-human-rights-advocates\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">urged<\/span><\/a><span style=\"font-weight: 400;\"> the Philippine government on 23 March 2023 to pass the bill as evidence of respect for human rights in the country. Earlier, <\/span><a href=\"https:\/\/srdefenders.org\/information\/more-disturbing-news-of-threats-to-hrds-in-the-philippines\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Lawlor<\/span><\/a><span style=\"font-weight: 400;\"> had already been critical of the many cases of &#8220;red-tagging&#8221; of HRDs, pointing out the dangers this practice poses to HRDs.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In Baguio City, &#8220;red-tagging&#8221; is already <\/span><a href=\"https:\/\/www.altermidya.net\/chr-reiterates-support-for-rights-defender-bill-urges-stop-of-fear-mongering\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">banned<\/span><\/a><span style=\"font-weight: 400;\">, making it safe for HRDs, according to Mayor Benjamin Magalong.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">On 23 March 2023, the Philippine government also announced that retired appellate judge Monina Arevalo-Zenarosa was <\/span><a href=\"https:\/\/www.philstar.com\/headlines\/2023\/03\/24\/2254052\/ex-ca-justice-named-chr-commissioner\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">appointed<\/span><\/a><span style=\"font-weight: 400;\"> as CHR commissioner. Zenarosa, along with three other judges, <\/span><a href=\"https:\/\/www.philstar.com\/headlines\/2023\/03\/24\/2254052\/ex-ca-justice-named-chr-commissioner\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">acquitted<\/span><\/a><span style=\"font-weight: 400;\"> US Marine Daniel Smith of raping a Filipina woman in Subic almost 18 years ago.
