{"id":7956,"date":"2023-03-20T01:00:59","date_gmt":"2023-03-20T00:00:59","guid":{"rendered":"https:\/\/amp.ngo\/?p=7956"},"modified":"2023-03-16T15:58:46","modified_gmt":"2023-03-16T14:58:46","slug":"philippine-government-appeals-reopening-of-icc-investigation","status":"publish","type":"post","link":"https:\/\/amp.ngo\/en\/philippine-government-appeals-reopening-of-icc-investigation\/","title":{"rendered":"Philippine government appeals reopening of ICC investigation"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">The Philippine government <\/span><a href=\"https:\/\/www.rappler.com\/nation\/philippines-appeal-icc-suspend-probe-drug-war-killings-rodrigo-duterte-march-2023\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">filed<\/span><\/a><span style=\"font-weight: 400;\"> an appeal with the International Criminal Court (ICC) against the reopening of the ICC investigation into alleged crimes against humanity on March 13, 2023. In its appeal brief, the government <a href=\"https:\/\/www.rappler.com\/nation\/philippines-appeal-icc-suspend-probe-drug-war-killings-rodrigo-duterte-march-2023\/\" target=\"_blank\" rel=\"noopener\">argues<\/a> that the ICC probe would \u201clack legal foundation&#8221; and &#8220;encroach on the sovereignty of the Republic of the Philippines.&#8221;\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In January 2023, the ICC Pre-Trial Chamber allowed Chief Prosecutor Karim Khan to investigate alleged <\/span><a href=\"https:\/\/www.panaynews.net\/jurisdiction-issue-a-script-line-to-attack-icc-rights-advocate\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">crimes<\/span><\/a><span style=\"font-weight: 400;\"> against humanity in relation to the so-called &#8220;war on drugs&#8221; under ex-president and ex-mayor of Davao, Rodrigo Duterte. President Ferdinand Marcos already described this decision as not a &#8220;<\/span><a href=\"https:\/\/www.rappler.com\/nation\/marcos-jr-cannot-cooperate-international-criminal-court-drug-war-killings-probe-jurisdiction-question\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">legitimate<\/span><\/a><span style=\"font-weight: 400;\"> judgement.&#8221;\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">At the end of February 2023, the ICC extended the <\/span><a href=\"https:\/\/news.abs-cbn.com\/news\/02\/18\/23\/icc-gives-ph-more-time-to-file-appeal-on-drug-war-killings-probe\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">deadline<\/span><\/a><span style=\"font-weight: 400;\"> to appeal the decision. President Marcos already stressed on 18 February 2023 that as long as those \u201cquestions of jurisdiction and the effects on the sovereignty of the republic are [not] sufficiently <\/span><a href=\"https:\/\/www.rappler.com\/nation\/marcos-jr-cannot-cooperate-international-criminal-court-drug-war-killings-probe-jurisdiction-question\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">answered<\/span><\/a><span style=\"font-weight: 400;\">,&#8221; he could not envision a cooperation with the ICC.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Philippine government also <\/span><a href=\"https:\/\/www.rappler.com\/nation\/philippines-appeal-icc-suspend-probe-drug-war-killings-rodrigo-duterte-march-2023\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">states<\/span><\/a><span style=\"font-weight: 400;\"> in its appeal brief that the ICC no longer has jurisdiction over the Philippines since it withdrew from the ICC on 19 March 2019. However, Carlos Conde of Human Rights Watch pointed out that the ICC retained its <\/span><a href=\"https:\/\/www.panaynews.net\/jurisdiction-issue-a-script-line-to-attack-icc-rights-advocate\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">authority<\/span><\/a><span style=\"font-weight: 400;\"> to investigate human rights violations in the &#8220;war on drugs.&#8221; This is because the Philippines was a <\/span><a href=\"https:\/\/news.abs-cbn.com\/news\/02\/18\/23\/icc-gives-ph-more-time-to-file-appeal-on-drug-war-killings-probe\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">party<\/span><\/a><span style=\"font-weight: 400;\"> to the ICC&#8217;s Rome Statute between 2011 and 2019.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Moreover, 19 congressmen filed a <\/span><a href=\"https:\/\/www.panaynews.net\/jurisdiction-issue-a-script-line-to-attack-icc-rights-advocate\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">resolution<\/span><\/a><span style=\"font-weight: 400;\"> in the House of Representatives on 16 February 2023 promising R. Duterte &#8220;unequivocal defense.&#8221; The resolution was <\/span><a href=\"https:\/\/news.abs-cbn.com\/news\/02\/18\/23\/icc-gives-ph-more-time-to-file-appeal-on-drug-war-killings-probe\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">led<\/span><\/a><span style=\"font-weight: 400;\">, among others, by ex-president and current deputy government spokesperson Gloria Macapagal-Arroyo. Congressman Johnny Pimentel defended the resolution by claiming that there was no clear <\/span><a href=\"https:\/\/news.abs-cbn.com\/news\/02\/18\/23\/icc-gives-ph-more-time-to-file-appeal-on-drug-war-killings-probe\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">evidence<\/span><\/a><span style=\"font-weight: 400;\"> linking Duterte to the extrajudicial killings. On February 20 the <\/span><a href=\"https:\/\/www.gmanetwork.com\/news\/topstories\/nation\/861485\/estrada-files-senate-resolution-opposing-icc-drug-war-probe\/story\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Senate<\/span><\/a><span style=\"font-weight: 400;\"> also filed under Senator Jinggoy Estrada&#8217;s leadership a resolution to protect Duterte regarding his involvement in the killings in the &#8220;war on drugs.&#8221;<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Human rights lawyers Neri Colmenares and Kristina Conti said the resolutions reflect the country&#8217;s continued <\/span><a href=\"https:\/\/www.panaynews.net\/jurisdiction-issue-a-script-line-to-attack-icc-rights-advocate\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">impunity<\/span><\/a><span style=\"font-weight: 400;\"> and would prevent a fair, comprehensive, and objective investigation. The human rights group Karapatan <\/span><a href=\"https:\/\/www.rappler.com\/nation\/proposed-house-resolution-supporting-rodrigo-duterte-vs-icc-grave-insult-drug-war-victims\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">called<\/span><\/a><span style=\"font-weight: 400;\"> the resolutions a &#8220;grave insult&#8221; to victims of the &#8220;war on drugs.&#8221; The network In Defence of Human Rights and Dignity (iDEFEND) <a href=\"https:\/\/www.rappler.com\/nation\/proposed-house-resolution-supporting-rodrigo-duterte-vs-icc-grave-insult-drug-war-victims\/\" target=\"_blank\" rel=\"noopener\">called<\/a> on the ICC to take the resolution as a sign to reject the government&#8217;s appeal. The youth organization <\/span><a href=\"https:\/\/www.rappler.com\/nation\/marcos-jr-cannot-cooperate-international-criminal-court-drug-war-killings-probe-jurisdiction-question\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Anakbayan<\/span><\/a><span style=\"font-weight: 400;\"> accused Marcos of double standards.
