{"id":12692,"date":"2026-02-20T06:55:29","date_gmt":"2026-02-20T05:55:29","guid":{"rendered":"https:\/\/amp.ngo\/?p=12692"},"modified":"2026-02-19T18:25:56","modified_gmt":"2026-02-19T17:25:56","slug":"icc-judges-reject-duterte-defense-claims-of-incapacity-set-hearing-for-feb-23","status":"publish","type":"post","link":"https:\/\/amp.ngo\/en\/icc-judges-reject-duterte-defense-claims-of-incapacity-set-hearing-for-feb-23\/","title":{"rendered":"ICC judges reject Duterte defense claims of incapacity, set hearing for Feb. 23"},"content":{"rendered":"<p>Former Philippine President Rodrigo Duterte will <a href=\"https:\/\/api-esp-ap.piano.io\/-c\/130\/38397\/494921\/1572029\/277831\/4f03bf260f7212a633614bc7f7b171ad\/315\/124717256?attrs=0&amp;order=2\" target=\"_blank\" rel=\"noopener\">face<\/a> the International Criminal Court (ICC) on February 23 for the confirmation of charges hearing, after judges <a href=\"https:\/\/api-esp-ap.piano.io\/-c\/130\/38397\/494921\/1572029\/277831\/4f03bf260f7212a633614bc7f7b171ad\/315\/124717256?attrs=0&amp;order=2\" target=\"_blank\" rel=\"noopener\">ruled<\/a> he is medically and cognitively fit to participate.<\/p>\n<p>Duterte <a href=\"https:\/\/www.icc-cpi.int\/sites\/default\/files\/2026-02\/DuterteEng.pdf\" target=\"_blank\" rel=\"noopener\">faces<\/a> three counts of crimes against humanity allegedly committed between November 2011 and March 2019. The charges <a href=\"https:\/\/www.icc-cpi.int\/sites\/default\/files\/2026-02\/DuterteEng.pdf\" target=\"_blank\" rel=\"noopener\">cover<\/a> murders carried out by the Davao Death Squad during his time as mayor of Davao City, killings of high-value targets during his presidency, and murders and attempted murders in barangay clearance operations while he was president.<\/p>\n<p>Despite the Philippines\u2019 2019 withdrawal from the Rome Statute, the ICC <a href=\"https:\/\/mb.com.ph\/2026\/01\/28\/drug-war-victims-to-take-part-in-duterte-icc-hearing-from-feb-2327\" target=\"_blank\" rel=\"noopener\">maintains<\/a> jurisdiction over alleged crimes committed while it was still a State Party.<\/p>\n<p>The hearing <a href=\"https:\/\/www.icc-cpi.int\/sites\/default\/files\/2026-02\/DuterteEng.pdf\" target=\"_blank\" rel=\"noopener\">aims<\/a> to assess whether sufficient evidence exists to reasonably believe that Duterte committed the alleged crimes. If any of the charges are confirmed, the case will <a href=\"https:\/\/www.icc-cpi.int\/sites\/default\/files\/2026-02\/DuterteEng.pdf\" target=\"_blank\" rel=\"noopener\">move<\/a> to a Trial Chamber, which will carry out the next stage of the process: the trial. The Chamber will <a href=\"https:\/\/www.icc-cpi.int\/sites\/default\/files\/2026-02\/DuterteEng.pdf\" target=\"_blank\" rel=\"noopener\">rule<\/a> on the confirmation of charges within 60 days after the hearing.<\/p>\n<p>Duterte has officially <a href=\"https:\/\/www.rappler.com\/philippines\/duterte-waives-appearance-icc-confirmation-charges-february-2026\/\" target=\"_blank\" rel=\"noopener\">waived<\/a> his right to attend the hearings to confirm the charges, even though the ICC has already <a href=\"https:\/\/globalnation.inquirer.net\/307982\/fwd-subject-victimss-lawyer-expects-dutertes-presence-in-icc-pretrial-hearing\" target=\"_blank\" rel=\"noopener\">taken<\/a> special measures to accommodate his health. In a statement dated February 18, 2026, Duterte <a href=\"https:\/\/www.rappler.com\/philippines\/duterte-waives-appearance-icc-confirmation-charges-february-2026\/\" target=\"_blank\" rel=\"noopener\">justified<\/a> this by saying that he did not recognize the ICC and that his extradition was a violation of the constitution and a delaying tactic. He also <a href=\"https:\/\/www.rappler.com\/philippines\/duterte-waives-appearance-icc-confirmation-charges-february-2026\/\" target=\"_blank\" rel=\"noopener\">stated<\/a> that the accusation that he had pursued a \u201cpolicy of extrajudicial killings\u201d was a lie.<\/p>\n<p>The Chamber <a href=\"https:\/\/mb.com.ph\/2026\/01\/28\/drug-war-victims-to-take-part-in-duterte-icc-hearing-from-feb-2327\" target=\"_blank\" rel=\"noopener\">set<\/a> the hearings for Feb. 23, 24, 26 and 27, and <a href=\"https:\/\/mb.com.ph\/2026\/01\/28\/drug-war-victims-to-take-part-in-duterte-icc-hearing-from-feb-2327\" target=\"_blank\" rel=\"noopener\">ordered<\/a> hourly breaks with sessions limited to a maximum of three hours each day. The final day will also <a href=\"https:\/\/mb.com.ph\/2026\/01\/28\/drug-war-victims-to-take-part-in-duterte-icc-hearing-from-feb-2327\" target=\"_blank\" rel=\"noopener\">include<\/a> a review of his detention.<\/p>\n<p>Joel Butuyan, Gilbert Andres, and Paolina Massidda of the Office of the Public Counsel for Victims (OPCV) were <a href=\"https:\/\/www.icc-cpi.int\/sites\/default\/files\/2026-02\/DuterteEng.pdf\" target=\"_blank\" rel=\"noopener\">appointed<\/a> by the ICC judges as a single team of legal representatives for admitted \u201cdrug war\u201d victims participating in the hearings.<\/p>\n<p>Duterte\u2019s defense team, headed by Nicholas Kaufman, is still <a href=\"https:\/\/qa.philstar.com\/headlines\/2026\/02\/05\/2505786\/kaufman-challenges-icc-ruling-dutertes-fitness\" target=\"_blank\" rel=\"noopener\">contesting<\/a> the ICC\u2019s decision that <a href=\"https:\/\/qa.philstar.com\/headlines\/2026\/02\/05\/2505786\/kaufman-challenges-icc-ruling-dutertes-fitness\" target=\"_blank\" rel=\"noopener\">found<\/a> him fit to stand trial. In a request <a href=\"https:\/\/qa.philstar.com\/headlines\/2026\/02\/05\/2505786\/kaufman-challenges-icc-ruling-dutertes-fitness\" target=\"_blank\" rel=\"noopener\">filed<\/a> on February 2, 2026, he challenged an earlier <a href=\"https:\/\/www.icc-cpi.int\/sites\/default\/files\/CourtRecords\/0902ebd180d979af.pdf\" target=\"_blank\" rel=\"noopener\">decision<\/a>, <a href=\"https:\/\/qa.philstar.com\/headlines\/2026\/02\/05\/2505786\/kaufman-challenges-icc-ruling-dutertes-fitness\" target=\"_blank\" rel=\"noopener\">arguing<\/a> that the judges <a href=\"https:\/\/qa.philstar.com\/headlines\/2026\/02\/05\/2505786\/kaufman-challenges-icc-ruling-dutertes-fitness\" target=\"_blank\" rel=\"noopener\">made<\/a> legal and factual mistakes by considering only the independent medical panel\u2019s reports while <a href=\"https:\/\/qa.philstar.com\/headlines\/2026\/02\/05\/2505786\/kaufman-challenges-icc-ruling-dutertes-fitness\" target=\"_blank\" rel=\"noopener\">overlooking<\/a> medical evidence presented by the defense.<\/p>\n<p>\u201cMr. Duterte <a href=\"https:\/\/qa.philstar.com\/headlines\/2026\/02\/05\/2505786\/kaufman-challenges-icc-ruling-dutertes-fitness\" target=\"_blank\" rel=\"noopener\">suffers<\/a> from cognitive impairment affecting multiple domains, including his memory, executive function and visuospatial skills,\u201d said Kaufman.<\/p>\n<p>The ICC Pre-Trial Chamber <a href=\"https:\/\/qa.philstar.com\/headlines\/2026\/02\/05\/2505786\/kaufman-challenges-icc-ruling-dutertes-fitness\" target=\"_blank\" rel=\"noopener\">upheld<\/a> the panel\u2019s findings as credible, stating that Duterte is capable of understanding the charges and exercising his rights, with appropriate support measures provided. Another <a href=\"https:\/\/qa.philstar.com\/headlines\/2026\/02\/05\/2505786\/kaufman-challenges-icc-ruling-dutertes-fitness\" target=\"_blank\" rel=\"noopener\">attempt<\/a> by the defense to overturn a separate decision regarding his continued detention was <a href=\"https:\/\/globalnation.inquirer.net\/309030\/icc-on-duterte-appeal-to-stand-trial-500-addl-applicants-to-participate-as-victims\" target=\"_blank\" rel=\"noopener\">rejected<\/a> by the ICC Pre-Trial Chamber on February 13, 2026, saying the Duterte defense \u201cfailed to raise appealable issues.\u201d<\/p>\n<p>On the same day, the prosecution of the ICC <a href=\"https:\/\/www.rappler.com\/philippines\/icc-additional-co-perpetrators-duterte-february-2026\/\" target=\"_blank\" rel=\"noopener\">published<\/a> a so-called \u201cpublic lesser redacted\u201d version of the charge sheet against Rodrigo Duterte, naming eight people as his indirect co-perpetrators in the crimes against humanity case. These persons are: 1) Senator Ronald \u201cBato\u201d dela Rosa, 2) Senator Bong Go, 3) former police chief Vicente Danao, 4) <a href=\"https:\/\/www.rappler.com\/philippines\/former-pnp-chief-camilo-cascolan-dies\/\" target=\"_blank\" rel=\"noopener\">the<\/a> late former chief of Davao Regional Police Camilo Cascolan, 5) former police chief Oscar Albayalde, 6) former National Bureau of Investigation chief Dante Gierran, 7) former Philippine Drug Enforcement Agency chief Isidro Lape\u00f1a, and 8) former justice secretary Vitaliano Aguirre II. The issuance of arrest warrants against the eight co-perpetrators is likely, <a href=\"https:\/\/www.rappler.com\/philippines\/icc-additional-co-perpetrators-duterte-february-2026\/\" target=\"_blank\" rel=\"noopener\">according<\/a> to ICC accredited assistant to council Ross Tugade.<\/p>\n<p>In a separate decision, issued on February 13, 2026, the ICC <a href=\"https:\/\/www.gmanetwork.com\/news\/topstories\/nation\/976494\/icc-victims-participation-duterte\/story\/\" target=\"_blank\" rel=\"noopener\">authorized<\/a> the participation of an additional 500 victims in the crimes against humanity case against Duterte, <a href=\"https:\/\/globalnation.inquirer.net\/309030\/icc-on-duterte-appeal-to-stand-trial-500-addl-applicants-to-participate-as-victims\" target=\"_blank\" rel=\"noopener\">bringing<\/a> the total number of participating victims to 539.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Former Philippine President Rodrigo Duterte will face the International Criminal Court (ICC) on February 23 for the confirmation of charges hearing, after judges ruled he is medically and cognitively fit to participate.
