{"id":12557,"date":"2026-01-27T06:55:47","date_gmt":"2026-01-27T05:55:47","guid":{"rendered":"https:\/\/amp.ngo\/?p=12557"},"modified":"2026-01-26T17:44:28","modified_gmt":"2026-01-26T16:44:28","slug":"supreme-court-upholds-drug-war-conviction-in-kian-delos-santos-killing","status":"publish","type":"post","link":"https:\/\/amp.ngo\/en\/supreme-court-upholds-drug-war-conviction-in-kian-delos-santos-killing\/","title":{"rendered":"Supreme Court upholds drug war conviction in Kian delos Santos killing"},"content":{"rendered":"<p>The Supreme Court has <a href=\"https:\/\/www.bulatlat.com\/2025\/12\/24\/sc-affirms-conviction-of-kians-killers\/\" target=\"_blank\" rel=\"noopener\">affirmed<\/a> the murder <a href=\"https:\/\/sc.judiciary.gov.ph\/sc-affirms-murder-conviction-of-police-officers-in-kian-delos-santos-case\/\" target=\"_blank\" rel=\"noopener\">conviction<\/a> of three police officers for the 2017 killing of 17-year-old Kian delos Santos during an anti-drug operation in Caloocan, ruling that the teenager was defenseless and unlawfully killed.<\/p>\n<p>In a decision, published on December 22, 2025, the Court <a href=\"https:\/\/mb.com.ph\/2025\/12\/23\/sc-ruling-on-kian-delos-santos-underscores-need-for-independent-truth-commissionpalace\" target=\"_blank\" rel=\"noopener\">found<\/a> police officers Arnel Oares, Jeremias Pereda, and Jerwin Cruz guilty of murder, sentenced them to up to 40 years in prison, and ordered them to pay delos Santos\u2019 family 275,000 Pesos in damages.<\/p>\n<p>The Court <a href=\"https:\/\/tribune.net.ph\/2025\/12\/23\/hontiveros-welcomes-sc-ruling-affirming-kian-delos-santos-murder-conviction\" target=\"_blank\" rel=\"noopener\">ruled<\/a> that Delos Santos was unarmed, forced to hold a planted gun, and shot multiple times, rejecting police claims of a shootout. It <a href=\"https:\/\/www.bulatlat.com\/2025\/12\/24\/sc-affirms-conviction-of-kians-killers\/\" target=\"_blank\" rel=\"noopener\">upheld<\/a> the rulings of the Regional Trial Court (RTC) and the Court of Appeals but <a href=\"https:\/\/www.bulatlat.com\/2025\/12\/24\/sc-affirms-conviction-of-kians-killers\/\" target=\"_blank\" rel=\"noopener\">modified<\/a> the penalty for the police officers by removing the phrase \u201cwithout eligibility for parole,\u201d explaining that this restriction applies only in cases where the death penalty is justified, which it found not applicable in Delos Santos\u2019 case.<\/p>\n<p>Senator Risa Hontiveros, along with human rights advocates, <a href=\"https:\/\/tribune.net.ph\/2025\/12\/23\/hontiveros-welcomes-sc-ruling-affirming-kian-delos-santos-murder-conviction\" target=\"_blank\" rel=\"noopener\">welcomed<\/a> the ruling but stressed that justice must go beyond the conviction of the three officers. She <a href=\"https:\/\/tribune.net.ph\/2025\/12\/23\/hontiveros-welcomes-sc-ruling-affirming-kian-delos-santos-murder-conviction\" target=\"_blank\" rel=\"noopener\">noted<\/a> that thousands of families have suffered similar losses and expressed hope that they, too, would eventually find justice.<\/p>\n<p>Government officials and lawmakers <a href=\"https:\/\/www.gmanetwork.com\/news\/topstories\/nation\/970594\/palace-truth-commission-for-duterte-era-drug-war-probe-worth-considering\/story\/\" target=\"_blank\" rel=\"noopener\">renewed<\/a> calls for an independent truth commission to investigate extrajudicial killings linked to former President Rodrigo Duterte\u2019s so called \u201cwar on drugs\u201d and hold higher authorities accountable.<\/p>\n<p>Critics have <a href=\"https:\/\/verafiles.org\/articles\/sc-icc-on-a-collision-course-over-case-of-tokhang-survivor-efren-morillo\" target=\"_blank\" rel=\"noopener\">pointed<\/a> to conflicting decisions, such as the Supreme Court\u2019s <a href=\"https:\/\/www.rappler.com\/newsbreak\/podcasts-videos\/efren-morillo-drug-war-supreme-court-status\/?utm_source=piano&amp;utm_medium=email&amp;utm_campaign=38397&amp;pnespid=9_6Py5VE4bfG_bO9vEeqpKZIvEtPvDVrwgoiBlVpsRaV4DXy1qZfcSoMv1ntydPtlMvEwcMm\" target=\"_blank\" rel=\"noopener\">dismissal<\/a> of charges against police in a 2016 Payatas operation, raising concerns about persistent gaps in domestic justice for drug war victims. Efren Morillo, the lone survivor of the said 2016 operation that <a href=\"https:\/\/www.rappler.com\/newsbreak\/podcasts-videos\/efren-morillo-drug-war-supreme-court-status\/?utm_source=piano&amp;utm_medium=email&amp;utm_campaign=38397&amp;pnespid=9_6Py5VE4bfG_bO9vEeqpKZIvEtPvDVrwgoiBlVpsRaV4DXy1qZfcSoMv1ntydPtlMvEwcMm\" target=\"_blank\" rel=\"noopener\">killed<\/a> four of his friends, had his criminal complaints against the police officers <a href=\"https:\/\/www.rappler.com\/newsbreak\/podcasts-videos\/efren-morillo-drug-war-supreme-court-status\/?utm_source=piano&amp;utm_medium=email&amp;utm_campaign=38397&amp;pnespid=9_6Py5VE4bfG_bO9vEeqpKZIvEtPvDVrwgoiBlVpsRaV4DXy1qZfcSoMv1ntydPtlMvEwcMm\" target=\"_blank\" rel=\"noopener\">dismissed<\/a> by the Ombudsman in 2023. The ruling was <a href=\"https:\/\/www.rappler.com\/newsbreak\/podcasts-videos\/efren-morillo-drug-war-supreme-court-status\/?utm_source=piano&amp;utm_medium=email&amp;utm_campaign=38397&amp;pnespid=9_6Py5VE4bfG_bO9vEeqpKZIvEtPvDVrwgoiBlVpsRaV4DXy1qZfcSoMv1ntydPtlMvEwcMm\" target=\"_blank\" rel=\"noopener\">upheld<\/a> by a division of the Supreme Court last November 2025.<\/p>\n<p>The families of Morillo and his friends <a href=\"https:\/\/www.rappler.com\/newsbreak\/podcasts-videos\/efren-morillo-drug-war-supreme-court-status\/?utm_source=piano&amp;utm_medium=email&amp;utm_campaign=38397&amp;pnespid=9_6Py5VE4bfG_bO9vEeqpKZIvEtPvDVrwgoiBlVpsRaV4DXy1qZfcSoMv1ntydPtlMvEwcMm\" target=\"_blank\" rel=\"noopener\">filed<\/a> a petition on December 5, 2025, to elevate the case to the Supreme Court en banc.<\/p>\n<p>The case of Morillo is <a href=\"https:\/\/verafiles.org\/articles\/sc-icc-on-a-collision-course-over-case-of-tokhang-survivor-efren-morillo\" target=\"_blank\" rel=\"noopener\">emblematic<\/a> for the International Criminal Court (ICC) as he is one of the very few eyewitnesses who survived the killing among the at least 27,000 extrajudicial killings linked to Rodrigo Duterte\u2019s \u201cwar on drugs.\u201d His case was also <a href=\"https:\/\/verafiles.org\/articles\/sc-icc-on-a-collision-course-over-case-of-tokhang-survivor-efren-morillo\" target=\"_blank\" rel=\"noopener\">stated<\/a> by the ICC in its decision, authorizing the investigation into the human rights violations in connection with the \u201cwar on drugs\u201d in 2021.<\/p>\n<p>Morillo and his lawyers Joel Butuyan and Gilbert Andres are now <a href=\"https:\/\/www.philstar.com\/headlines\/2025\/12\/06\/2492359\/duterte-icc-tokhang-survivor-seeks-justice-supreme-court\" target=\"_blank\" rel=\"noopener\">questioning<\/a> why the mastermind behind the \u201cwar on drugs\u201d is detained in The Hague but those who carried out the killings locally remain unpunished.<\/p>\n<p>&nbsp;<\/p>\n<p>Photo \u00a9 Raffy Lerma<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Supreme Court has affirmed the murder conviction of three police officers for the 2017 killing of 17-year-old Kian delos Santos during an anti-drug operation in Caloocan, ruling that the teenager was defenseless and unlawfully killed.
