{"id":12221,"date":"2025-11-03T06:55:22","date_gmt":"2025-11-03T05:55:22","guid":{"rendered":"https:\/\/amp.ngo\/?p=12221"},"modified":"2025-10-31T13:53:28","modified_gmt":"2025-10-31T12:53:28","slug":"tough-struggle-in-protection-petitions-in-enforced-disappearance-cases","status":"publish","type":"post","link":"https:\/\/amp.ngo\/en\/tough-struggle-in-protection-petitions-in-enforced-disappearance-cases\/","title":{"rendered":"Tough struggle in protection petitions in enforced disappearance cases"},"content":{"rendered":"<p>Nearly a year after Cora Jazmines <a href=\"https:\/\/www.bulatlat.com\/2025\/10\/02\/hearing-for-disappeared-labor-activist-starts-almost-a-year-after-filing\/\" target=\"_blank\" rel=\"noopener\">filed<\/a> petitions for writs of amparo and habeas data* over the disappearance of her husband, labor activist James Jazmines, the Court of Appeals finally held its first summary hearing on October 2, 2025.<\/p>\n<p>James Jazmines was <a href=\"https:\/\/www.bulatlat.com\/2025\/10\/02\/hearing-for-disappeared-labor-activist-starts-almost-a-year-after-filing\/\" target=\"_blank\" rel=\"noopener\">disappeared<\/a> on August 23, 2024, after attending a friend\u2019s birthday celebration. That friend, Felix Salaveria Jr., was <a href=\"https:\/\/www.bulatlat.com\/2025\/10\/02\/hearing-for-disappeared-labor-activist-starts-almost-a-year-after-filing\/\" target=\"_blank\" rel=\"noopener\">disappeared<\/a> five days later; both remain missing. James, a veteran labor and student activist, had <a href=\"https:\/\/www.bulatlat.com\/2025\/10\/02\/hearing-for-disappeared-labor-activist-starts-almost-a-year-after-filing\/\" target=\"_blank\" rel=\"noopener\">worked<\/a> with the League of Filipino Students, Kilusang Mayo Uno, and the Amado V. Hernandez Resource Center. His wife Cora, under temporary court protection, continues to <a href=\"https:\/\/www.bulatlat.com\/2025\/10\/02\/hearing-for-disappeared-labor-activist-starts-almost-a-year-after-filing\/\" target=\"_blank\" rel=\"noopener\">seek<\/a> accountability from several military and police officials, including former AFP chief Romeo Brawner Jr. and former PNP chief Rommel Marbil. \u201cRed-tagging\u201d is a practice of labeling individuals or organizations \u2014often without evidence \u2014 as members of the armed communist insurgency or as terrorists, which can expose them to harassment, violence, or legal repercussions.<\/p>\n<p>JL Burgos, chairperson of Desaparecidos &#8211; an organization of families and friends of victims of enforced disappearances &#8211; <a href=\"https:\/\/www.bulatlat.com\/2025\/10\/02\/hearing-for-disappeared-labor-activist-starts-almost-a-year-after-filing\/\" target=\"_blank\" rel=\"noopener\">said<\/a> they remain cautiously optimistic about a favorable ruling to the petition for protective writs filed by Jazmines\u2019 family.<\/p>\n<p>In a statement, Burgos <a href=\"https:\/\/www.bulatlat.com\/2025\/10\/02\/hearing-for-disappeared-labor-activist-starts-almost-a-year-after-filing\/\" target=\"_blank\" rel=\"noopener\">expressed<\/a> uncertainty about the outcome, noting the Court of Appeals\u2019 inconsistent record in granting such writs. He also <a href=\"https:\/\/www.bulatlat.com\/2025\/10\/02\/hearing-for-disappeared-labor-activist-starts-almost-a-year-after-filing\/\" target=\"_blank\" rel=\"noopener\">cited<\/a> the court\u2019s previous denial of writs for environmental activists, disappearance survivors Jhed Tamano, Jonila Castro, and Francisco \u201cEco\u201d Dangla III.<\/p>\n<p>Despite the court\u2019s acknowledgment that Dangla was <a href=\"https:\/\/www.bulatlat.com\/2025\/10\/01\/braving-trauma-survivor-eco-dangla-appeals-court-denial-of-protection\/\" target=\"_blank\" rel=\"noopener\">abducted<\/a>, a victim of so-called \u201cred-tagging,\u201d and that security forces failed in their duty of diligence, his plea for protection was still denied, underscoring the gap between state accountability and justice.<\/p>\n<p>Dangla, assisted by the National Union of Peoples\u2019 Lawyers (NUPL), <a href=\"https:\/\/www.bulatlat.com\/2025\/10\/01\/braving-trauma-survivor-eco-dangla-appeals-court-denial-of-protection\/\" target=\"_blank\" rel=\"noopener\">filed<\/a> a motion for reconsideration, presenting evidence linking military personnel to his abduction.<\/p>\n<p>Human rights group Karapatan <a href=\"https:\/\/www.bulatlat.com\/2025\/10\/01\/braving-trauma-survivor-eco-dangla-appeals-court-denial-of-protection\/\" target=\"_blank\" rel=\"noopener\">criticized<\/a> the ruling as reinforcing impunity, saying it \u201cadmits the crime but absolves the perpetrators.\u201d Similar denials have been <a href=\"https:\/\/nordis.net\/2025\/10\/02\/article\/news\/ilocos\/dismissal-of-protective-writs-for-pangasinan-activist-draws-outcry\/\" target=\"_blank\" rel=\"noopener\">issued<\/a> in the cases of the enforced disappearance of Jonila Castro and Jhed Tamano as well as killed human rights defender Zara Alvarez.<\/p>\n<p>The controversy has <a href=\"https:\/\/www.bulatlat.com\/2025\/08\/30\/the-long-overdue-ratification-of-un-convention-on-enforced-disappearance-in-ph\/\" target=\"_blank\" rel=\"noopener\">revived<\/a> calls for the Philippines to ratify the International Convention for the Protection of All Persons Against Enforced Disappearance (ICPPED).<\/p>\n<p>Human rights groups <a href=\"https:\/\/www.bulatlat.com\/2025\/08\/30\/the-long-overdue-ratification-of-un-convention-on-enforced-disappearance-in-ph\/\" target=\"_blank\" rel=\"noopener\">argue<\/a> that the country\u2019s 2012 national Anti-Enforced Disappearance Law has failed, with zero convictions, no budget for implementation, and persistent noncompliance by security forces. Ratification of the ICPPED, they say, would <a href=\"https:\/\/www.rappler.com\/philippines\/deadliest-country-asia-environmental-defenders-2024\/\" target=\"_blank\" rel=\"noopener\">allow<\/a> international oversight and strengthen accountability.<\/p>\n<p>The <a href=\"https:\/\/www.bulatlat.com\/2025\/08\/05\/two-environmental-defenders-killed-two-days-before-sona\/\" target=\"_blank\" rel=\"noopener\">killings<\/a> of environmental defenders Rudolph Dela Cruz Espe and Rico Gonzaga Malubay in Davao Oriental on July 26, 2025, just days before President Ferdinand Marcos Jr.\u2019s State of the Nation Address, <a href=\"https:\/\/www.bulatlat.com\/2025\/08\/05\/two-environmental-defenders-killed-two-days-before-sona\/\" target=\"_blank\" rel=\"noopener\">highlight<\/a> the risks faced by land and environmental defenders.<\/p>\n<p>According to Global Witness, the Philippines <a href=\"https:\/\/www.rappler.com\/philippines\/deadliest-country-asia-environmental-defenders-2024\/\" target=\"_blank\" rel=\"noopener\">remained<\/a> the deadliest country in Asia for environmental defenders in 2024, marking its 12th consecutive year at the top of the list.<\/p>\n<p>&nbsp;<\/p>\n<p>* The writ of amparo is a legal remedy and protection available to any person whose right to life, liberty, or security has been violated or is threatened.
