The court <a href=\"https:\/\/www.rappler.com\/philippines\/icc-denies-duterte-interim-release-request-october-10-2025\/\" target=\"_blank\" rel=\"noopener\">rejected<\/a> humanitarian pleas, noting he retains visitation and communication rights with family members.<\/p>\n<p>Duterte\u2019s lawyers <a href=\"https:\/\/www.rappler.com\/philippines\/senate-approves-resolution-urging-icc-duterte-house-arrest\/\" target=\"_blank\" rel=\"noopener\">argued<\/a> the 80-year-old former leader is medically unfit for trial due to cognitive decline. The ICC <a href=\"https:\/\/www.rappler.com\/newsbreak\/podcasts-videos\/duterte-undergo-icc-neuropsych-exams\/\" target=\"_blank\" rel=\"noopener\">ordered<\/a> independent neuropsychological and psychiatric examinations to determine his fitness to stand trial. The confirmation of charges hearing, originally set for September 2025, has been <a href=\"https:\/\/www.rappler.com\/philippines\/icc-prosecutors-charge-rodrigo-duterte-counts-murder\/\" target=\"_blank\" rel=\"noopener\">postponed<\/a> pending the results.<\/p>\n<p>ICC prosecutors, <a href=\"https:\/\/www.rappler.com\/philippines\/icc-prosecutors-charge-rodrigo-duterte-counts-murder\/\" target=\"_blank\" rel=\"noopener\">led<\/a> by Deputy Prosecutor Mame Mandiaye Niang, <a href=\"https:\/\/www.rappler.com\/philippines\/icc-prosecutors-charge-rodrigo-duterte-counts-murder\/\" target=\"_blank\" rel=\"noopener\">accuse<\/a> Duterte with three counts of widespread murder for alleged crimes against humanity committed during his terms as Davao City mayor and president.<\/p>\n<p>The charges <a href=\"https:\/\/www.rappler.com\/philippines\/icc-prosecutors-charge-rodrigo-duterte-counts-murder\/\" target=\"_blank\" rel=\"noopener\">cover<\/a> three sets of incidents: (i) murder of 19 people in Davao City between 2013 and 2016; (ii) killing of 14 \u201chigh-value targets\u201d during his presidency from 2016 to 2017; and (iii) murder and attempted murder of 45 people in barangay*-level operations from 2016 to 2018.<\/p>\n<p>The ICC <a href=\"https:\/\/www.rappler.com\/philippines\/icc-prosecutors-charge-rodrigo-duterte-counts-murder\/\" target=\"_blank\" rel=\"noopener\">classifies<\/a> such acts as crimes against humanity when part of a widespread or systematic attack on civilians.<\/p>\n<p>In a ruling dated October 23, 2025, ICC judges Julia Motoc, Reine Alapini-Gansou and Mar\u00eda del Socorro Flores Liera <a href=\"https:\/\/newsinfo.inquirer.net\/2129400\/in-yet-another-victory-for-drug-war-victims-icc-affirms-jurisdiction-over-duterte-case-2?utm_medium=social&amp;utm_source=facebook&amp;fbclid=IwY2xjawNnR0lleHRuA2FlbQIxMQABHgzheZQq9L3ZEQnvSidZDGjRISEV95yLhOImrGWKUSuv8fl82BKox1hRWMhi_aem_vEyHOHuRXcRzmR_gg5FZaQ\" target=\"_blank\" rel=\"noopener\">confirmed<\/a> the court\u2019s jurisdiction over the case, rejecting Duterte\u2019s claim that the Philippines\u2019 2019 withdrawal from the Rome Statute removed ICC authority.<\/p>\n<p>The ICC judges <a href=\"https:\/\/newsinfo.inquirer.net\/2129400\/in-yet-another-victory-for-drug-war-victims-icc-affirms-jurisdiction-over-duterte-case-2?utm_medium=social&amp;utm_source=facebook&amp;fbclid=IwY2xjawNnR0lleHRuA2FlbQIxMQABHgzheZQq9L3ZEQnvSidZDGjRISEV95yLhOImrGWKUSuv8fl82BKox1hRWMhi_aem_vEyHOHuRXcRzmR_gg5FZaQ\" target=\"_blank\" rel=\"noopener\">said<\/a> that the investigation began in 2018, before the withdrawal took effect, making the proceedings valid under Article 127 of the statute. The ruling <a href=\"https:\/\/newsinfo.inquirer.net\/2129400\/in-yet-another-victory-for-drug-war-victims-icc-affirms-jurisdiction-over-duterte-case-2?utm_medium=social&amp;utm_source=facebook&amp;fbclid=IwY2xjawNnR0lleHRuA2FlbQIxMQABHgzheZQq9L3ZEQnvSidZDGjRISEV95yLhOImrGWKUSuv8fl82BKox1hRWMhi_aem_vEyHOHuRXcRzmR_gg5FZaQ\" target=\"_blank\" rel=\"noopener\">clears<\/a> the way for a potential full trial once Duterte\u2019s medical evaluation is complete.<\/p>\n<p>Duterte\u2019s lawyer, Nicholas Kaufman, earlier <a href=\"https:\/\/www.rappler.com\/philippines\/marcos-jr-government-not-agree-duterte-interim-release\/\" target=\"_blank\" rel=\"noopener\">told<\/a> the ICC that the Marcos administration had \u201cno objection\u201d to his interim release, <a href=\"https:\/\/www.rappler.com\/philippines\/marcos-jr-government-not-agree-duterte-interim-release\/\" target=\"_blank\" rel=\"noopener\">citing<\/a> a statement from Palace Press Undersecretary Claire Castro.<\/p>\n<p>Castro later <a href=\"https:\/\/www.rappler.com\/philippines\/marcos-jr-government-not-agree-duterte-interim-release\/\" target=\"_blank\" rel=\"noopener\">clarified<\/a> that her remarks were taken out of context and accused Kaufman of \u201ctwisting facts.\u201d Justice Secretary Jesus Crispin Remulla <a href=\"https:\/\/www.rappler.com\/philippines\/marcos-jr-government-not-agree-duterte-interim-release\/\" target=\"_blank\" rel=\"noopener\">said<\/a> interim release was \u201cnot appropriate,\u201d adding that Duterte could receive proper medical care in the Netherlands.<\/p>\n<p>The Philippine Senate earlier <a href=\"https:\/\/www.rappler.com\/philippines\/senate-approves-resolution-urging-icc-duterte-house-arrest\/\" target=\"_blank\" rel=\"noopener\">passed<\/a> Resolution No. 144 urging the ICC to place Duterte under house arrest for humanitarian reasons. The resolution <a href=\"https:\/\/www.rappler.com\/philippines\/senate-approves-resolution-urging-icc-duterte-house-arrest\/\" target=\"_blank\" rel=\"noopener\">passed<\/a> 15\u20133 with two abstentions but has no legal effect, as the ICC holds full jurisdiction.<\/p>\n<p>Human rights groups <a href=\"https:\/\/www.rappler.com\/philippines\/rodrigo-duterte-house-arrest-senate-resolution-statements-rights-groups-lawmakers\/\" target=\"_blank\" rel=\"noopener\">criticized<\/a> the resolution as an attempt to shield Duterte from accountability, saying it showed the justice system remained \u201charsh on the poor but soft on the powerful.\u201d<\/p>\n<p>Families of drug war victims and human rights advocates <a href=\"https:\/\/www.rappler.com\/philippines\/icc-denies-duterte-interim-release-request-october-10-2025\/\" target=\"_blank\" rel=\"noopener\">welcomed<\/a> the ICC\u2019s decision to keep Duterte in detention, calling it a step toward justice after years of delay. They <a href=\"https:\/\/www.rappler.com\/philippines\/victims-duterte-drug-war-hope-expansion-murder-charges-lawyer\/\" target=\"_blank\" rel=\"noopener\">urged<\/a> the court to expand the charges to include torture and illegal detention.<\/p>\n<p>Human rights groups <a href=\"https:\/\/www.rappler.com\/philippines\/victims-duterte-drug-war-hope-expansion-murder-charges-lawyer\/\" target=\"_blank\" rel=\"noopener\">estimate<\/a> that up to 30,000 people were killed in Duterte\u2019s campaign against illegal drugs, while official police figures list over 6,000 deaths.<\/p>\n<p>Despite his detention, Duterte <a href=\"https:\/\/time.com\/7319559\/philippines-rodrigo-duterte-icc-charges-murder\/\" target=\"_blank\" rel=\"noopener\">remains<\/a> a powerful political figure.
