{"id":11694,"date":"2025-07-15T00:55:48","date_gmt":"2025-07-14T23:55:48","guid":{"rendered":"https:\/\/amp.ngo\/?p=11694"},"modified":"2025-07-14T14:40:04","modified_gmt":"2025-07-14T13:40:04","slug":"un-special-rapporteur-irene-khan-criticizes-philippine-governments-shortcomings-on-freedom-of-expression","status":"publish","type":"post","link":"https:\/\/amp.ngo\/en\/un-special-rapporteur-irene-khan-criticizes-philippine-governments-shortcomings-on-freedom-of-expression\/","title":{"rendered":"UN Special Rapporteur Irene Khan criticizes Philippine government\u2019s shortcomings on freedom of expression"},"content":{"rendered":"<p>In a report <a href=\"https:\/\/www.rappler.com\/philippines\/un-rapporteur-irene-khan-report-june-2025\/\" target=\"_blank\" rel=\"noopener\">presented<\/a> to the United Nations Human Rights Council (UNHRC) on June 18, 2025, UN Special Rapporteur on Freedom of Expression Irene Khan gave a critical assessment on the situation of human rights in the Philippines under President Ferdinand Marcos Jr., highlighting ongoing challenges to press freedom and freedom of opinion in the country.<\/p>\n<p>While <a href=\"https:\/\/www.rappler.com\/philippines\/un-rapporteur-irene-khan-report-june-2025\/\" target=\"_blank\" rel=\"noopener\">acknowledging<\/a> some improvements compared to the former Rodrigo Duterte administration, Khan observed that meaningful change remains elusive. Problems such as the practice of so-called \u201cred-tagging,\u201d suppression of dissent, and a persistent culture of impunity <a href=\"https:\/\/www.rappler.com\/philippines\/un-rapporteur-irene-khan-report-june-2025\/\" target=\"_blank\" rel=\"noopener\">continue<\/a> to undermine freedom of expression and the safety of journalists.<\/p>\n<p>\u201cRed-tagging,\u201d which is defined as the practice of labeling activists, journalists, and government critics as \u201ccommunists\u201d or \u201cterrorists\u201d without evidence, <a href=\"https:\/\/www.philstar.com\/headlines\/2025\/06\/25\/2453236\/un-rapporteur-marcos-set-consequences-red-tagging-officials\" target=\"_blank\" rel=\"noopener\">remains<\/a> widespread, despite official government denials. Khan condemned this practice for enabling harassment, arbitrary arrests, and even killings. Between January and June 2024 alone, 467 cases of \u201cred-tagging\u201d were <a href=\"https:\/\/www.philstar.com\/headlines\/2025\/06\/25\/2453236\/un-rapporteur-marcos-set-consequences-red-tagging-officials\" target=\"_blank\" rel=\"noopener\">documented<\/a>.<\/p>\n<p>The UN expert <a href=\"https:\/\/www.philstar.com\/headlines\/2025\/06\/25\/2453236\/un-rapporteur-marcos-set-consequences-red-tagging-officials\" target=\"_blank\" rel=\"noopener\">recommended<\/a> concrete steps to end this abuse, including amending the controversial Anti-Terrorism Act (ATA) of 2020 and abolishing the National Task Force to End Local Communist Armed Conflict (NTF-ELCAC), an agency that is criticized for its \u201cred-tagging\u201d attacks against activists. Khan also <a href=\"https:\/\/www.ohchr.org\/en\/documents\/country-reports\/ahrc5950add1-visit-philippines-report-special-rapporteur-promotion-and\" target=\"_blank\" rel=\"noopener\">encouraged<\/a> the Philippines to define terrorism according to UN resolutions, as acts against civilians committed with the intention of causing death or serious injury.<\/p>\n<p>Khan\u2019s report also <a href=\"https:\/\/www.rappler.com\/philippines\/un-rapporteur-irene-khan-report-june-2025\/\" target=\"_blank\" rel=\"noopener\">highlighted<\/a> the detention of community journalist Frenchie Mae Cumpio, held for over five years without conviction on questionable charges related to alleged illegal firearms possession and terrorism financing. International press freedom organizations have <a href=\"https:\/\/www.rappler.com\/philippines\/un-rapporteur-irene-khan-report-june-2025\/\" target=\"_blank\" rel=\"noopener\">called<\/a> for her immediate release, condemning her prolonged detention as a \u201ctravesty of justice.\u201d<\/p>\n<p>At least four journalists have been <a href=\"https:\/\/www.rappler.com\/philippines\/un-rapporteur-irene-khan-report-june-2025\/\" target=\"_blank\" rel=\"noopener\">killed<\/a> under the Marcos administration, and Khan noted that the pace of investigation into the crimes has been slow.<\/p>\n<p>Khan <a href=\"https:\/\/www.rappler.com\/philippines\/un-rapporteur-irene-khan-report-june-2025\/\" target=\"_blank\" rel=\"noopener\">criticized<\/a> the Presidential Task Force on Media Security (PTFOMS) for its weak enforcement and lack of credibility among journalists. The taskforce aims to address in coordination with other government entities threats and harassments against journalists. Khan <a href=\"https:\/\/www.ohchr.org\/en\/documents\/country-reports\/ahrc5950add1-visit-philippines-report-special-rapporteur-promotion-and\" target=\"_blank\" rel=\"noopener\">mentioned<\/a> that the PTFOMS is not functional in all police stations or even known. She also called for a reform of the PTFOMS so that it <a href=\"https:\/\/www.ohchr.org\/en\/documents\/country-reports\/ahrc5950add1-visit-philippines-report-special-rapporteur-promotion-and\" target=\"_blank\" rel=\"noopener\">has<\/a> the \u201cnecessary institutional independence\u201d. Khan also <a href=\"https:\/\/www.ohchr.org\/en\/documents\/country-reports\/ahrc5950add1-visit-philippines-report-special-rapporteur-promotion-and\" target=\"_blank\" rel=\"noopener\">called<\/a> for major reforms including the decriminalization of libel and the appointment of a special prosecutor to oversee crimes against media workers and human rights defenders.<\/p>\n<p>Khan also <a href=\"https:\/\/www.rappler.com\/philippines\/un-rapporteur-irene-khan-report-june-2025\/\" target=\"_blank\" rel=\"noopener\">urged<\/a> the passage of a genuine Freedom of Information (FOI) law aligned with international standards, criticizing the Marcos Jr. administration for imposing broad exemptions that limit public access to information. She also <a href=\"https:\/\/www.philstar.com\/headlines\/2025\/06\/25\/2453236\/un-rapporteur-marcos-set-consequences-red-tagging-officials\" target=\"_blank\" rel=\"noopener\">recommended<\/a> rejoining the International Criminal Court and <a href=\"https:\/\/www.bulatlat.com\/2025\/06\/25\/heed-un-special-rapporteurs-recommendations-families-of-victims-of-drug-related-killings-tell-marcos-jr\/\" target=\"_blank\" rel=\"noopener\">ratifying<\/a> key human rights treaties to strengthen the country\u2019s legal framework.<\/p>\n<p>Local journalist groups, including the National Union of Journalists of the Philippines (NUJP), have <a href=\"https:\/\/www.rappler.com\/philippines\/un-rapporteur-irene-khan-report-june-2025\/\" target=\"_blank\" rel=\"noopener\">echoed<\/a> Khan\u2019s calls. The NUJP <a href=\"https:\/\/www.rappler.com\/philippines\/un-rapporteur-irene-khan-report-june-2025\/\" target=\"_blank\" rel=\"noopener\">documented<\/a> 177 media freedom violations since Marcos Jr. took office, many resembling the oppressive tactics of the Duterte era. They <a href=\"https:\/\/www.bulatlat.com\/2025\/06\/27\/statement-on-united-nations-side-event-with-committee-to-protect-journalists-and-un-expert-irene-khan\/\" target=\"_blank\" rel=\"noopener\">emphasized<\/a> the need to repeal or reform laws like the ATA and to <a href=\"https:\/\/www.bulatlat.com\/2025\/06\/27\/statement-on-united-nations-side-event-with-committee-to-protect-journalists-and-un-expert-irene-khan\/\" target=\"_blank\" rel=\"noopener\">lift<\/a> restrictions on alternative media outlets.<\/p>\n<p>The Baguio City Council unanimously <a href=\"https:\/\/www.rappler.com\/philippines\/luzon\/baguio-council-resolution-united-nations-irene-khan-human-rights-report-2025\/\" target=\"_blank\" rel=\"noopener\">endorsed<\/a> Khan\u2019s report and recommendations, condemning the Anti-Terrorism Council\u2019s power to designate terrorists without due process and urging local authorities to review dubious terrorism cases against activists. Baguio has <a href=\"https:\/\/www.rappler.com\/philippines\/luzon\/baguio-council-resolution-united-nations-irene-khan-human-rights-report-2025\/\" target=\"_blank\" rel=\"noopener\">declared<\/a> itself an inclusive human rights city, adopting local measures to combat \u201cred tagging.\u201d<\/p>\n<p>The Philippine government <a href=\"https:\/\/www.rappler.com\/philippines\/luzon\/baguio-council-resolution-united-nations-irene-khan-human-rights-report-2025\/\" target=\"_blank\" rel=\"noopener\">rejected<\/a> Khan\u2019s report, defending its anti-insurgency policies and denying systemic \u201cred tagging.\u201d It <a href=\"https:\/\/docs.un.org\/en\/A\/HRC\/59\/50\/Add.3\" target=\"_blank\" rel=\"noopener\">maintains<\/a> that the ATA and the NTF-ELCAC are necessary to combat insurgency and terrorism. It also <a href=\"https:\/\/docs.un.org\/en\/A\/HRC\/59\/50\/Add.3\" target=\"_blank\" rel=\"noopener\">highlights<\/a> that the Philippines has its own definition of \u201cterrorist\u201d, determined in the ATA, which however has been widely criticized because of its extremely broad and vague definition of terrorism.<\/p>\n<p>In its official response, the Philippine government also <a href=\"https:\/\/docs.un.org\/en\/A\/HRC\/59\/50\/Add.3\" target=\"_blank\" rel=\"noopener\">noted<\/a> in its official response, that the PTFOMS should stay government led. Moreover, it <a href=\"https:\/\/docs.un.org\/en\/A\/HRC\/59\/50\/Add.3\" target=\"_blank\" rel=\"noopener\">disagreed<\/a> with Khan, saying the right to peaceful assembly is feely exercised in the Philippines. According to the Philippine government, Khan\u2019s assessment of oppression of journalists and free speech may only be <a href=\"https:\/\/docs.un.org\/en\/A\/HRC\/59\/50\/Add.3\" target=\"_blank\" rel=\"noopener\">referring<\/a> to specific cases.<\/p>\n<p>The NTF-ELCAC <a href=\"https:\/\/www.bulatlat.com\/2025\/06\/26\/group-blasts-elcacs-lies-against-un-expert\/\" target=\"_blank\" rel=\"noopener\">dismissed<\/a> the UN-expert\u2019s findings as \u201clies,\u201d though human rights organizations and the Philippine Supreme Court have <a href=\"https:\/\/www.bulatlat.com\/2025\/06\/26\/group-blasts-elcacs-lies-against-un-expert\/\" target=\"_blank\" rel=\"noopener\">validated<\/a> claims of \u201cred-tagging\u201d and associated abuses.<\/p>\n<p>Khan <a href=\"https:\/\/www.philstar.com\/headlines\/2025\/06\/25\/2453236\/un-rapporteur-marcos-set-consequences-red-tagging-officials\" target=\"_blank\" rel=\"noopener\">concluded<\/a> that while the Philippines has a vibrant civil society and active media, state-led repression continues to cast a shadow over these freedoms.
