{"id":11140,"date":"2025-04-14T00:55:37","date_gmt":"2025-04-13T23:55:37","guid":{"rendered":"https:\/\/amp.ngo\/?p=11140"},"modified":"2025-04-12T13:24:26","modified_gmt":"2025-04-12T12:24:26","slug":"u-s-sanctions-threaten-iccs-existence","status":"publish","type":"post","link":"https:\/\/amp.ngo\/en\/u-s-sanctions-threaten-iccs-existence\/","title":{"rendered":"U.S. sanctions threaten ICC&#8217;s existence"},"content":{"rendered":"<p>United States President Donald Trump <a href=\"https:\/\/www.amnesty.org\/en\/latest\/campaigns\/2025\/03\/what-do-the-trump-administrations-sanctions-on-the-icc-mean-for-justice-and-human-rights\/\" target=\"_blank\" rel=\"noopener\">issued<\/a> sweeping sanctions on February 6, 2025, targeting the International Criminal Court (ICC) and its Chief Prosecutor Karim Khan. The sanctions, aimed at blocking the Court\u2019s investigations into American and allied nationals, have drawn sharp criticism from the international community, with legal experts and human rights groups <a href=\"https:\/\/www.amnesty.org\/en\/latest\/campaigns\/2025\/03\/what-do-the-trump-administrations-sanctions-on-the-icc-mean-for-justice-and-human-rights\/\" target=\"_blank\" rel=\"noopener\">warning<\/a> that they pose a serious threat to the global justice system.<\/p>\n<p>These sanctions <a href=\"https:\/\/theconversation.com\/the-icc-showed-its-might-by-arresting-rodrigo-duterte-its-reputation-will-take-longer-to-fix-252509\" target=\"_blank\" rel=\"noopener\">come<\/a> at a time when the ICC is making headlines for a historic success: the arrest of former Philippine President Rodrigo Duterte last March 11, 2025. Just five days after an arrest warrant was issued, Duterte was apprehended and transferred to The Hague, becoming the first former Asian head of state to stand trial before the Court. His <a href=\"https:\/\/www.icc-cpi.int\/sites\/default\/files\/2025-03\/DuterteEng.pdf\" target=\"_blank\" rel=\"noopener\">prosecution<\/a> is tied to widespread human rights violations during his violent so-called \u201cwar on drugs,\u201d which led to at least 27,000 extrajudicial killings, according <a href=\"https:\/\/www.rappler.com\/voices\/thought-leaders\/opinion-slingshot-how-many-extrajudicial-killings-under-duterte\/\" target=\"_blank\" rel=\"noopener\">estimates<\/a> of the Philippine Commission on Human Rights.<\/p>\n<p>Trump\u2019s executive order <a href=\"https:\/\/www.amnesty.org\/en\/latest\/campaigns\/2025\/03\/what-do-the-trump-administrations-sanctions-on-the-icc-mean-for-justice-and-human-rights\/\" target=\"_blank\" rel=\"noopener\">allows<\/a> the U.S. to freeze assets and ban travel for any non-American individual who supports ICC investigations into U.S. citizens, military personnel, or citizens of close allies\u2014including Israel and the Philippines\u2014without those nations\u2019 consent. So far, ICC Prosecutor Karim Khan has been <a href=\"https:\/\/verafiles.org\/articles\/fact-check-us-sanctions-on-icc-have-no-effect-on-duterte-drug-war-probe\" target=\"_blank\" rel=\"noopener\">sanctioned<\/a>, with others potentially at risk. These punitive measures are widely viewed as retaliatory, <a href=\"https:\/\/www.amnesty.org\/en\/latest\/campaigns\/2025\/03\/what-do-the-trump-administrations-sanctions-on-the-icc-mean-for-justice-and-human-rights\/\" target=\"_blank\" rel=\"noopener\">stemming<\/a> from the ICC\u2019s investigations into alleged war crimes in Palestine and Ukraine. Arrest warrants have been <a href=\"https:\/\/www.amnesty.org\/en\/latest\/campaigns\/2025\/03\/what-do-the-trump-administrations-sanctions-on-the-icc-mean-for-justice-and-human-rights\/\" target=\"_blank\" rel=\"noopener\">issued<\/a> for Israeli Prime Minister Benjamin Netanyahu, Defense Minister Yoav Gallant, and Russian President Vladimir Putin\u2014none of whom recognize the ICC\u2019s jurisdiction.<\/p>\n<p>The US sanctions pose an <a href=\"https:\/\/www.france24.com\/en\/live-news\/20250207-existential-threat-what-next-for-the-icc-after-us-sanctions\" target=\"_blank\" rel=\"noopener\">existential threat<\/a> to the ICC, in particular the financial restrictions will undermine the ICC and its ongoing investigations into war crimes, as UN experts <a href=\"https:\/\/www.ohchr.org\/en\/press-releases\/2025\/02\/united-states-un-experts-condemn-sanctions-against-icc\" target=\"_blank\" rel=\"noopener\">highlighted<\/a> in a statement. Thus, this may also affect ongoing trials such as against Duterte.<\/p>\n<p>The international backlash against U.S. sanctions has been swift. Over 150 NGOs, coordinated by the Coalition for the International Criminal Court, issued a <a href=\"https:\/\/www.coalitionfortheicc.org\/oppose-sanctions-against-ICC-safeguard-victims-access-justice\" target=\"_blank\" rel=\"noopener\">joint statement<\/a> in January 2025 condemning the move. They contend that the sanctions risk undermining the ICC\u2019s efforts, hindering justice for victims, and discouraging international collaboration. The European Union and dozens of ICC member states have <a href=\"https:\/\/www.amnesty.org\/en\/latest\/campaigns\/2025\/03\/what-do-the-trump-administrations-sanctions-on-the-icc-mean-for-justice-and-human-rights\/\" target=\"_blank\" rel=\"noopener\">expressed<\/a> \u201cunwavering support\u201d for the Court. In February 2025, 79 member states <a href=\"https:\/\/buildingtrust.si\/79-states-parties-in-support-of-the-icc\/#:%7E:text=Afghanistan%2C%20Albania%2C%20Andorra%2C%20Antigua,%2C%20France%2C%20Gabon%2C%20Gambia%2C\" target=\"_blank\" rel=\"noopener\">reaffirmed<\/a> their commitment to fighting impunity and protecting the Court\u2019s independence from political interference.<\/p>\n<p>Legal experts have <a href=\"https:\/\/verafiles.org\/articles\/fact-check-us-sanctions-on-icc-have-no-effect-on-duterte-drug-war-probe\" target=\"_blank\" rel=\"noopener\">called<\/a> for the adoption of protective laws\u2014such as the EU\u2019s blocking statute\u2014to shield ICC officials and civil society actors from retaliation. This has also been a major call of a <a href=\"https:\/\/www.hrw.org\/news\/2025\/04\/04\/eu-should-defend-icc\" target=\"_blank\" rel=\"noopener\">statement<\/a> of Human Rights Watch and a number of supporting organizations, published on April 4, 2025. They also <a href=\"https:\/\/www.hrw.org\/news\/2025\/04\/04\/eu-should-defend-icc\" target=\"_blank\" rel=\"noopener\">stressed<\/a> that several ICC members, including Mongolia, South Africa, Italy and most recently Hungary, have breached their obligation to the ICC to implement arrest warrants, thus <a href=\"https:\/\/theconversation.com\/the-icc-showed-its-might-by-arresting-rodrigo-duterte-its-reputation-will-take-longer-to-fix-252509\" target=\"_blank\" rel=\"noopener\">weakening<\/a> the court\u2019s reputation. This serves as a reminder of the Court\u2019s structural vulnerabilities. The ICC has issued <a href=\"https:\/\/theconversation.com\/the-icc-showed-its-might-by-arresting-rodrigo-duterte-its-reputation-will-take-longer-to-fix-252509\" target=\"_blank\" rel=\"noopener\">56 arrest<\/a> warrants since its founding in 2002, but fewer than half have been enforced.<\/p>\n<p>Against this backdrop, Duterte\u2019s arrest <a href=\"https:\/\/www.coalitionfortheicc.org\/news\/PCICC-arrest-duterte#:~:text=The%20arrest%20of%20former%20President%20Rodrigo%20Duterte%20today,of%20the%20War%20on%20Drugs%20in%20the%20Philippines.\" target=\"_blank\" rel=\"noopener\">represents<\/a> a major step toward accountability for thousands of victims and families who have long sought justice for the extrajudicial killings carried out under his anti-drug campaign.<\/p>\n<p>&nbsp;<\/p>\n<p>Photo \u24b8 International Criminal Court<\/p>\n","protected":false},"excerpt":{"rendered":"<p>United States President Donald Trump issued sweeping sanctions on February 6, 2025, targeting the International Criminal Court (ICC) and its Chief Prosecutor Karim Khan.
